Pursue a Claim

From the client's account to settlement or court proceedings, with artificial intelligence support.

Looplex’s Pursue a Claim solution helps law firms and legal departments prepare and carry out the steps needed to pursue a client’s claim.

The work begins with the facts presented to the lawyer: what happened, who is involved, what harm or difficulties the client has reported, and what outcome the client wants to achieve. Using this information, the solution organizes the collection of supporting materials, assists with legal assessment and strategy development, prepares materials for a potential settlement, and, when court proceedings are the chosen course, helps draft the initial pleading, organize the supporting documents, generate court fee payment forms, and prepare the submission for electronic filing.

The workflow also includes creating and updating the matter in the management systems used by the firm and its client, keeping matter information connected to the work performed. The procedures described here reflect the Brazilian legal context.

Understanding the facts and the client’s objective

The lawyer provides the client’s account and the available materials, such as contracts, correspondence, receipts, notices, and customer service records. These materials do not need to have been organized into a legal theory or a final set of claims.

The Assistant helps structure the narrative, identify the participants, establish a chronology, and clarify the intended outcome. It also highlights questions that require further discussion with the client, distinguishing reported facts from information supported by documents and matters that still require confirmation.

At this stage, the work can flag situations that require the lawyer’s immediate attention, such as a risk of losing evidence, relevant deadlines, or the need for urgent relief. These issues help determine the priority of the next steps.

Gathering and analyzing supporting materials

Based on the client’s account and the legal theories under consideration, the solution organizes a plan for collecting information and evidence. This plan can cover:

  • Documents and records held by the client or available in connected systems.
  • Interviews and follow-up questions with the client, employees, and others familiar with the facts.
  • Identification of potential witnesses and the events they can address.
  • Technical information, calculations, and other materials needed to understand the matter.

Evidence gathering can take place through interaction with the lawyer, tasks assigned to responsible team members, or integrations with the organization’s information sources.

The collected materials are linked to the facts they help establish. The Assistant helps identify gaps, inconsistencies, and information that may weaken the claim, allowing the team to direct further requests and assess whether additional evidence is needed.

Developing the strategy with the lawyer

The strategy develops as the facts and supporting materials are analyzed. The Assistant works with the lawyer to assess the legal grounds, potential claims, weaknesses in the case, and arguments the opposing party may raise.

Depending on the matter, the work can support an assessment of the appropriate procedural route, the parties to the dispute, jurisdiction, the amounts involved, and any steps required before filing. It can also organize the information needed to assess urgent relief and the practical feasibility of the client’s intended outcome.

The lawyer can compare alternatives, adjust the approach, and request further research or analysis. New information may lead to a revised strategy and additional requests for supporting materials.

The organization’s templates, legal positions, and criteria guide the work through its legal playbooks. The responsible professionals retain authority over strategy and approval of the steps to be taken.

Assessing and preparing for settlement

The workflow includes assessing whether to pursue an agreed resolution, taking into account the client’s objectives, the urgency of the matter, the history of the relationship, and the lawyer’s instructions.

The solution can help prepare extrajudicial notices, settlement proposals, communications to the opposing party, and materials for negotiation, conciliation, or mediation. This can include preparation for a pre-litigation attempt at resolution through a Brazilian Judicial Center for Conflict Resolution and Citizenship, known as a CEJUSC. Learn about CEJUSCs from the National Council of Justice (in Portuguese).

The lawyer defines the approach, negotiation parameters, and required approvals. The work organizes incoming responses and outstanding issues for further discussions, subject to applicable confidentiality requirements.

If the parties reach an agreement, the workflow can proceed to documenting it and recording the obligations and the people responsible for follow-up. If the settlement is partial, the lawyer identifies the issues that still require action.

If a settlement attempt is ruled out or does not produce the intended result, the work proceeds to preparing court proceedings, using the facts and documents already organized.

Preparing the initial pleading and supporting documents

Once the decision to file has been made, the Assistant helps draft the initial pleading in line with the approved strategy, the available materials, and the organization’s drafting standards.

The work brings together the factual account, legal grounds, requested relief, and references to the documents supporting the claim. It also helps organize attachments and identify documents or information still needed, such as powers of attorney, party identification details, supporting records, and calculation schedules.

The review considers consistency among the narrative, legal grounds, requested relief, and evidence. The lawyer can request changes and supplement the supporting materials before approving the version to be submitted for filing.

Court fees and preparation for electronic filing

Preparation for court proceedings includes support for calculating court fees and generating the applicable payment forms, depending on the court, procedure, and enabled features. The forms are sent to the person responsible for payment, and payment receipts are included in the filing documents when required. This stage uses the Court Fee Calculation and Payment Forms solution.

After legal review and completion of the necessary steps, the pleading and its attachments proceed to electronic filing. Preparation can include checking the files, signatures, and data required by the destination system.

Where Looplex Filing is integrated, the workflow can track the submission and incorporate the receipt returned by the court. The work record distinguishes document preparation, submission, and confirmation of filing.

Creating and updating the matter in management systems

The matter can be registered before court proceedings begin, allowing the team to track it while the facts are investigated and alternatives are assessed.

The solution creates or updates records in Looplex Cases, Promad, and other integrated systems. This includes situations in which the firm needs to register the matter both in its own system and in the management platform used by the client’s legal department.

Depending on the integration, the workflow reuses party information, the subject of the matter, responsible team members, amounts, documents, and the status of the work. After the case is registered with the court, the record can be supplemented with the case number, the assigned court, and the filing receipt.

The operations available in each system depend on the integrations, permissions, and fields configured for the organization.

Supervising and reviewing the work

Looplex Assistant participates in the analysis and preparation of deliverables. In Autopilot mode, delegated activities follow the configured workflow, with supervision in Workbench.

In this environment, the lawyer provides instructions, answers requests for clarification, examines the materials, and reviews the results. Decisions on settlement, filing proceedings, and the content of submissions follow the responsibilities and approval authority established for the matter.

Throughout the process, the organization maintains a history of the facts, evidence, analyses, and steps taken. This continuity reduces repeated requests for information and supports the transition from preparing the matter to managing the court case or settlement.
